Conditions of sale

1. The contract

All reservations are made through VIATGES TRAVELTEC TOURISTIC SERVICES SL, a travel agency that operates as VIATGES TRAVELTEC TOURISTIC SERVICES SL. By making a reservation with us, you are deemed to have accepted these Reservation Conditions (which constitute the complete agreement between the client and us) and the reservation is accepted based on them. The services that will be provided are detailed in the booking confirmation invoice.

2. Acceptance of the reservation and final payments

If the reservation is accepted, a confirmation invoice will be issued. There will be a contract between both parties from the date of issue of the confirmation invoice, or if the reservation is made within 7 days prior to departure, the contract will exist when the deposit is accepted. Please review the confirmation invoice for information on final payments. The remaining balance of the trip price must be paid 46 days before the departure date. If payment is not made on or before the due date, we reserve the right to cancel the reservation.

By making a reservation with us, it is accepted that you understand and assume the possible risks and dangers that may be involved in the contracted activities. In the case of activities that involve some physical or mental effort, it is the client’s responsibility to assess whether he is able to carry them out and participate in them. The client is responsible for bringing the appropriate clothing and equipment, which will be informed at the time of contracting the service. VIATGES TRAVELTEC TOURISTIC SERVICES SL, together with the guide/leader and any other person who works in association with us, will not be responsible for any accident or delay that may occur in relation to any part or service related to the trip.

3. The data provided

To confirm the trip, all the requested details must be provided together with the payment of the remaining balance of the trip price. These details include the full number according to the passport, date of birth, nationality, passport number, date of issuance and expiration of the passport, and any pre-existing medical condition (including allergies) that may affect the ability to complete the trip. The reservation cannot be confirmed without these details.

4. Cost of travel

Please note that changes and errors may occur. The price of the selected trip must be consulted at the time of booking. We reserve the right to increase/decrease and correct errors in the prices announced at any time before the confirmation of the reservation. In the event of an error, you will be informed of the error and the price applicable at the time of the reservation. In such cases, responsibility is assumed for the first 2% of the additional costs and the rest is responsible. If any surcharge results in an increase of more than 10% of the price of the trip, the reservation can be canceled within 14 days after notification of the surcharge and a full refund will be obtained. No surcharge will be charged for booking the trip within the validity period of the travel publication.

5. Cancellation by the traveler

In case of total or partial cancellation of the reservation, cancellation charges will apply. Cancellation will only be effective if a written confirmation is received. The cancellation charges are broken down as follows:

Up to 46 days or more before departure: 20% cancellation fee (loss of deposit)
From 21 to 46 days before departure: 50% cancellation fee
20 days or less before departure: 100% charge for cancellation
Please request full details of cancellation charges at the time of booking. It is strongly recommended to take out cancellation insurance at the time of booking that covers cancellation costs. If you abandon a trip for any reason after it has started, you are not obliged to make any refund for unused services.

6. Cancellation by VIATGES TRAVELTEC TOURISTIC SERVICES SL

In the unlikely event that the vacation has to be canceled for reasons beyond:

Customer fault
force majeure
Insufficient numbers to proceed with the trip (for scheduled guided tours)
Alternative holidays of at least a comparable standard will be offered if they are available. If these vacations cost less than the original reservation, the difference will be refunded. If you do not wish to reserve an alternative or it is not available, the full amount will be refunded. In circumstances where the cancellation is due to external events beyond reasonable control, the refunds will be minus the irrecoverable costs.

No responsibility is assumed for any incidental expenses that may have been incurred as a result of booking, including but not limited to visas, vaccinations, excess travel insurance or non-refundable flights.

7. Force majeure

Except as otherwise expressly stated in these booking conditions, no liability can be accepted and no compensation will be paid where performance of obligations under the contract is prevented or affected by “force majeure”. In these conditions, “force majeure” refers to any event that cannot be foreseen or avoided even with due care, both by us and by the service provider. These events may include actual or threatened war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire, and other similar events beyond our control.

8. Changes to the reservation

If you want to transfer the reservation to another trip or to another person, you must notify us at least 46 days before the departure date. A change fee of €120 per person will apply (in addition to any charges charged by hotels, ground operators or others). If the notification is made less than 46 days in advance, the corresponding cancellation policy will apply. Transfers to third parties are only allowed if they meet the requirements of the trip, and transfers to another departure can only be made within the current validity period.

Any other changes to the travel arrangement will incur an administration fee of €60 per booking. This fee is in addition to any fees charged by hotels, ground operators or others. No changes to the reservation are allowed within 10 days prior to departure.

9. Itinerary change

Although we do our best to operate the trip as described, we reserve the right to change the itinerary. It is recommended to check our website prior to departure for the latest updates.

Before departure: In case of making an important change, you will be informed as soon as possible. Any modification that affects at least one day out of five of the itinerary is considered a major change. In the event of an important change, it can be accepted, request a refund of the money paid only in the land part of the trip or accept an alternative route offered.

After departure: We reserve the right to change the itinerary after departure due to local circumstances or events beyond our control. In such circumstances, you will have to cover the additional cost of any necessary changes to the itinerary. Please note that we are not responsible for any incidental expenses you may incur as a result of changing your itinerary, such as visas, vaccinations or non-refundable flights.

10. Age and health requirements

Minimum Age: On most trips, children are required to be at least 12 years old. All travelers under the age of 18 must be accompanied by an adult responsible for their daily care. Please note that we cannot guarantee triple or adjacent rooms for families; Accompanying adults may be required to share a room with other party members in double occupancy.

Maximum age: On most trips there is no maximum age limit, although it is important to note that some activities can be physically demanding.

We can provide information on mandatory health requirements, but we are not medical experts. It is your responsibility to ensure that you obtain adequate and detailed medical advice at least two months prior to travel so that you are aware of the latest health requirements, recommendations for your destination and any associated costs. If you fail to do so and you are denied entry into any country, or suffer personal injury or death as a result, we will not be responsible for any costs, losses or damages.

11. Small groups and package tours

Our trips are guaranteed once a traveler has made full payment, unless otherwise stated due to minimum group size. This means that on some occasions we can have small groups. Many of our trips are designed to be combined with other departures to form one longer trip. This implies that some members of your party may have been traveling together for a few weeks before your trip begins. If you want to know how many people are booked on your trip or on a package trip you are participating in, please ask before making your reservation.

12. Passport and visas

We will do our best to assist in finding and booking suitable travel arrangements for your trip. However, it is the responsibility of the traveler to carry a valid passport and to obtain all appropriate visas, permits and certificates for the countries to be visited during the trip. The passport must be valid for six months beyond the duration of the trip. It is the responsibility of the traveler to ensure that they have the correct visas, permits and certificates for the trip. We do not assume any responsibility if you are denied entry into a country due to a lack of correct passport, visa or other travel documentation.

13. Travel insurance

Travel insurance is mandatory for all travelers and must be purchased at the time of booking. Travel insurance must provide coverage against personal accidents, death, medical expenses and emergency repatriation, with a recommended minimum coverage of 150,000 euros per traveler. Coverage for cancellation, reduction, personal liability, and loss of baggage and personal effects is also strongly recommended. The traveler must provide proof of their travel insurance on the first day of the trip; you will not be allowed to join the trip without such insurance. If you obtain travel insurance through us, you acknowledge that you are satisfied with the level of insurance we have taken out.

14. Liability

By completing the reservation form, it is accepted that the excursions of VIATGES TRAVELTEC TOURISTIC SERVICES SL (horse riding, biking, hiking, trekking and multi-activity) are classified as risk sports that require adequate physical conditions, and the characteristics of the trails are accepted. and its difficulties.

We assume liability for the negligence of our staff or agents resulting in death or physical injury to persons, or loss of or damage to personal property, only to the extent that applicable law requires us to do so. Our obligations, and those of our suppliers who provide any services or facilities included in your holiday, are to use reasonable skill and care in arranging for the provision of such services and facilities (this acceptance of liability is subject to the clause below) .

We will not be liable for any damage or loss if your breach of contract is:

Attributable to the traveler.
Attributable to a third party unrelated to the provision of the contracted services and the fact is unforeseeable.

15. Optional activities

Optional activities that are not included in the tour price are not part of the tour or this contract. By accepting any assistance provided to you by our tour leader or local representative in arranging optional activities, you acknowledge that we are not responsible for such activities in any way. The contract for the provision of said activity will be between the traveler and the corresponding provider.

16. Claims and complaints

In case you have any complaint or are not satisfied with any aspect of the trip, it is requested to inform the guide or local representative immediately, so that they can try to solve the problem. If the matter cannot be satisfactorily resolved locally and you wish to file a complaint, you should contact VIATGES TRAVELTEC TOURISTIC SERVICES SL by phone or email immediately so that we can try to resolve the situation. In case of not achieving satisfaction through these means, any other complaint must be sent in writing within 30 days after the end of the tour. If these instructions are not followed, we will not accept any responsibility for the matter that gave rise to the complaint, as we were unable to address it immediately or investigate it in a timely manner.

17. Severability

In the event that any provision contained in these Booking Conditions cannot be applied or is void according to the law or goes against public policy or for any other reason, said provision will be considered separated from this contract or modified accordingly, only to the extent necessary to allow the other remaining provisions to survive and be binding.

18. Photos and marketing

By accepting these Booking Conditions, consent is given to use images taken during the trip for advertising and promotional purposes in any medium of your choice. A perpetual, royalty-free, worldwide, irrevocable license is also granted to use such images for advertising and promotional purposes.

19. Privacy Policy

Any personal information collected about the traveler may be used for any purpose associated with the operation of the trip or to send marketing material related to events and special offers. The information may be disclosed to agents, service providers or other vendors to enable the operation of the trip. Otherwise, the data will be processed in accordance with the privacy policy, which can be consulted on the website.

20. Applicable law

These Booking Conditions are governed by the laws of Spain to the maximum extent permitted. Any dispute related to a trip or these Booking Conditions must be initiated in the courts of Spain.
